1. Acceptance of these Terms
These Terms of Use ("Terms") govern your download, installation, and use of the Apertura application for macOS ("Apertura", "the app") and the notch-os.com website. By installing or using Apertura you agree to these Terms. If you do not agree, do not install or use the app.
2. The software; preview mode
Apertura is a utility that extends the display area around the MacBook camera housing ("notch") with productivity modules. The app may be downloaded free of charge and runs in a limited preview mode until a valid license key is activated. Features available in each paid tier are described on the website at the time of purchase.
3. Licenses and license keys
- Each paid tier is a one-time purchase that grants you a personal, non-exclusive, non-transferable license to use Apertura on the number of devices stated at checkout.
- License keys are personal. Reselling, publishing, or sharing a key beyond your permitted devices is prohibited and may result in deactivation.
- You may deactivate a device and move your license to another Mac you own.

5. License verification and anti-tampering
Paid functionality is verified server-side. The app periodically confirms your entitlement with our license service; tampering with, reverse-engineering around, or circumventing license verification is prohibited and voids your license without refund. A modified or cracked build receives no paid functionality.
6. Payments, taxes, and refunds
Purchases are processed by our merchant of record, which is responsible for payment processing, applicable taxes, and invoicing. Refunds are handled according to the merchant of record's refund policy as presented at checkout.
7. AI features
Some tiers include AI-assisted features. AI requests are routed exclusively through our authenticated backend; an on-device mode is available where supported, in which case prompts are processed locally and never leave your Mac. You agree not to use AI features to generate unlawful content or to violate the rights of others. AI output may be inaccurate; you are responsible for verifying it before relying on it.
8. Acceptable use
You may not use Apertura to violate any applicable law, to infringe the rights of third parties, or to interfere with the operation of our services. You may not probe, overload, or attack our backend infrastructure.
9. Intellectual property
Apertura, its design, and its services are protected by copyright and other laws. These Terms grant you a license to use the app; they do not transfer any ownership rights.
10. Warranty disclaimer
Apertura is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, in no event shall Apertura or its team be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the app. Our total liability shall not exceed the amount you paid for your license in the twelve months preceding the claim.
12. Termination
We may suspend or terminate your license if you materially breach these Terms, including license-key abuse or circumvention of verification. You may stop using the app at any time by uninstalling it.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version; material changes will be announced on this page. Continued use of the app after changes take effect constitutes acceptance.
14. Governing language
These Terms are drafted in English. Translations of the website interface are provided for convenience only; in case of conflict, the English version prevails.
